Since approval of the EU General Data Protection Regulation (GDPR) in 2016, it has been widely and repeatedly claimed that the GDPR will legally mandate a ‘right to explanation’ of all decisions made by automated or artificially intelligent algorithmic systems. This right to explanation is viewed as an ideal mechanism to enhance the accountability and transparency of automated decision-making. However, there are several reasons to doubt both the legal existence and the feasibility of such a right. In contrast to the (...) right to explanation of specific automated decisions claimed elsewhere, the GDPR only mandates that data subjects receive meaningful, but properly limited, information (Articles 13-15) about the logic involved, as well as the significance and the envisaged consequences of automated decision-making systems, what we term a ‘right to be informed’. Further, the ambiguity and limited scope of the ‘right not to be subject to automated decision-making’ contained in Article 22 (from which the alleged ‘right to explanation’ stems) raises questions over the protection actually afforded to data subjects. These problems show that the GDPR lacks precise language as well as explicit and well-defined rights and safeguards against automated decision-making, and therefore runs the risk of being toothless. We propose a number of legislative and policy steps that, if taken, may improve the transparency and accountability of automated decision-making when the GDPR comes into force in 2018. (shrink)

Explores what the last few decades of European/American, feminist, and postcolonial science and technology studies can learn from each other. This book proposes new directions for thinking about objectivity, method, and reflexivity in light of the new understandings developed in the post-World War II world.

Biological knowledge does not fit the image of science that philosophers have developed. Many argue that biology has no laws. Here I criticize standard normative accounts of law and defend an alternative, pragmatic approach. I argue that a multidimensional conceptual framework should replace the standard dichotomous law/ accident distinction in order to display important differences in the kinds of causal structure found in nature and the corresponding scientific representations of those structures. To this end I explore the dimensions of stability, (...) strength, and degree of abstraction that characterize the variety of scientific knowledge claims found in biology and other sciences. Where the old objectivity question asked, Objectivity or relativism: which side are you on?, the new one refuses this choice, seeking instead to bypass widely recognized problems with the conceptual framework that restricts the choices to these two. It asks, How can the notion of objectivity be updated and made useful for contemporary knowledge-seeking projects? One response to this question is the strong objectivity program that draws on feminist standpoint epistemology to provide a kind of logic of discovery for maximizing (...) our ability to block might makes right in the sciences. It does so by delinking the neutrality ideal from standards for maximizing objectivity, since neutrality is now widely recognized as not only not necessary, not only not helpful, but, worst of all, an obstacle to maximizing objectivity when knowledge-distorting interests and values have constituted a research project. Strong objectivity provides a method for correcting this kind of situation. However, standpoint approaches have their own limitations which are quite different from the misreadings of them upon which most critics have tended to focus. Unfortunately, historically limited epistemologies and philosophies of science are all we get to choose from at this moment in history. (shrink)

Beatty, Brandon, and Sober agree that biological generalizations, when contingent, do not qualify as laws. Their conclusion follows from a normative definition of law inherited from the Logical Empiricists. I suggest two additional approaches: paradigmatic and pragmatic. Only the pragmatic represents varying kinds and degrees of contingency and exposes the multiple relationships found among scientific generalizations. It emphasizes the function of laws in grounding expectation and promotes the evaluation of generalizations along continua of ontological and representational parameters. Stability of conditions (...) and strength of determination in nature govern projectibility. Accuracy, ontological level, simplicity, and manageability provide additional measures of usefulness. Recent calls to address racism in bioethics reflect a sense of urgency to mitigate the lethal effects of a lack of action. While the field was catalyzed largely in response to pivotal events deeply rooted in racism and other structures of oppression embedded in research and health care, it has failed to center racial justice in its scholarship, pedagogy, advocacy, and practice, and neglected to integrate anti-racism as a central consideration. Academic bioethics programs play a key role in determining the (...) field’s norms and practices, including methodologies, funding priorities, and professional networks that bear on equity, inclusion, and epistemic justice. This article describes recommendations from the Racial Equity, Diversity, and Inclusion (REDI) Task Force commissioned by the Association of Bioethics Program Directors to prioritize and strengthen anti-racist practices in bioethics programmatic endeavors and to evaluate and develop specific goals to advance REDI. The `fact' of pluralism in science is nosurprise. Yet, if science is representing andexplaining the structure of the oneworld, why is there such a diversity ofrepresentations and explanations in somedomains? In this paper I consider severalphilosophical accounts of scientific pluralismthat explain the persistence of bothcompetitive and compatible alternatives. PaulSherman's `Levels of Analysis' account suggeststhat in biology competition betweenexplanations can be partitioned by the type ofquestion being investigated. I argue that thisaccount does not locate competition andcompatibility correctly. I then defend anintegrative (...) model for understanding pluralism. This view is based on taking seriously both thecomplexity and contingency of biologicalorganization and the idealized character ofbiological models. On this view, explanationbecomes, among other things, the location forthe integration of diverse models. I explicatemy argument by an analysis of explanations ofdivision of labor in social insects. By the start of the twenty-first century, the notion of ‘the sublime’ had come to seem incoherent. In the last ten years or so considerable light has been shed by empirical psychologists on a related notion of ‘awe’, and a fruitful dialogue between aestheticians and empirical psychologists has ensued. It is the aim of this paper to synthesize these advances and to offer what I call a ‘two-tiered’ theory of the sublime that shows it to be a coherent aesthetic category. (...) On this theory, sublime experiences begin in an ‘awe response’ (the ‘thin sublime’) and might, with the additional element of temporally-extended reflection, turn into a ‘thick sublime’ response. Building on accounts of the sublime as a species of ‘aesthetic awe’ (Clewis, 2019a and 2019b; Arcangeli, et al., 2020) I aim to show that this two-tiered theory helps to explain why sublime experiences seem to have a basic, primordial core, but also seem to be historically and culturally quite variable (as Nicolson, 1963 [1959]; Battersby, 2007; and McMahon, 2017 have stressed). On this model, the cultural and historical variability comes in largely at the point of the temporally-extended reflection characteristic of the thick sublime, due to the cognitive stock that the subject brings to the encounter. Thus, sublime experiences really lend themselves to being interpreted quite variously by the subject (as well as by the theorist) of these experiences, as, for example, affording insight into the Divine, our moral vocation, or our metaphysical unity with the entire universe, among other lofty thoughts. The scope and method of logic as we know it today eminently reflect the ground-breaking developments of set theory and the logical foundations of mathematics at the turn of the 20th century. Unfortunately, little effort has been made to understand the idiosyncrasies of the philosophical context that led to these tremendous innovations in the 19thcentury beyond what is found in the works of mathematicians such as Frege, Hilbert, and Russell. This constitutes a monumental gap in our understanding of the central (...) influences that shaped 19th-century thought, from Kant to Russell, and that helped to create the conditions in which analytic philosophy could emerge. -/- The aim of Logic from Kant to Russell is to document the development of logic in the works of 19th-century philosophers. It contains thirteen original essays written by authors from a broad range of backgrounds—intellectual historians, historians of idealism, philosophers of science, and historians of logic and analytic philosophy. These essays question the standard narratives of analytic philosophy’s past and address concerns that are relevant to the contemporary philosophical study of language, mind, and cognition. James articulates and defends a Spinozist view of the interplay between poetry and philosophy: philosophy has an ineliminably poetic content, and poetry is an aid and support to philosophy. In this piece, I juxtapose James’s Spinozist schema with another schema available within Spinoza’s historical milieu. In Ibn Tufayl’s view, rather than poetry being an aid to philosophy, poetry opens to a world of experience that even the best philosophy cannot grasp. For flat-footed philosophers who think that philosophy can in principle (...) have the last word on everything, poetics might give an approximate indication of a kind of experience that lies beyond it. This paper presents a novel analysis of Sluicing, an ellipsis construction first described by Ross (1969) and illustrated by the bracketed portion ofI want to do something, but I'm just not sure [what _]. Starting from the assumption that a sluice consists of a displaced Wh-constituent and an empty IP, we show how simple and general LF operations fill out the empty IP and thereby provide it with an interpretable Logical Form. The LF operations we appeal to rely on the (...) influential theory of indefinites developed by Irene Heim and Hans Kamp, and are in harmony with certain aspects of Chomsky's Minimalist Program for linguistic theory. The analysis accounts directly for the familiar properties of Sluicing, as well as some facts which have not previously been observed. (shrink)

Using classical American pragmatism, the authors provide a philosophical framework for rethinking the nature of the corporation--how it is embedded in its natural, technological, cultural, and international environments, emphasizing throughout its pervasive relational and moral dimensions. They explore the relationship of this framework to other contemporary business ethics perspectives, as well as its implications for moral leadership in business and business education.

It has been claimed that ceteris paribus laws, rather than strict laws are the proper aim of the special sciences. This is so because the causal regularities found in these domains are exception-ridden, being contingent on the presence of the appropriate conditions and the absence of interfering factors. I argue that the ceteris paribus strategy obscures rather than illuminates the important similarities and differences between representations of causal regularities in the exact and inexact sciences. In particular, a detailed account of (...) the types and degrees of contingency found in the domain of biology permits a more adequate understanding of the relations among the sciences. (shrink)

In this paper, we present a Lacanian perspective on football, while notably fathoming its normative dimension. Starting with a defining imperative, the prohibition against ‘handling’ or touching the ball with your hands, diverging football historically from rugby, we will subsequently focus our attention on the role of the foot, the eye (notably the eyes of the audience) and the ‘object a’ (in the context of gender). Against this backdrop, we will address pressing issues such as the troubled position of the (...) referee (as an ‘impossible profession’), the commercialisation of football, and the rising tides of violence, match—fixing and other instances of systemic deviance. As we will argue, football exemplifies modern sport as an arena defined by prohibitions and desire, by inclusion and exclusion, by purity and abuse, culminating in recent challenges involved in gender trouble. Symbolical practices, like modern football, are based on in- and exclusion. Instead of more regulations and dichotomies, we advocate careful attention to the delicate art of handling desire in practice. (shrink)

ABSTRACT Recently, children’s books have used augmented reality as a resource, being called 4D books. Augmented reality allows the user to see through the world while interacting in real-time with images produced digitally, resulting in interactivity. The present study aims to introduce the results of a brief reflection on the illustrated book O reino encantado do pôneis 4D under the approach of the semiotics of culture, departing from the notion of semiosis and semiosphere. The semiosphere, drawn by Lotman (1990), in (...) analogy with the biosphere, can help understand the topology of the real and virtual worlds, referred to as the real subsemiosphere and virtual subsemiosphere, located in the interior of the broader semiosphere of the Brazilian culture. In 4D/Augmented reality books, the elements from the virtual subsemiosphere are placed into the real subsemiosphere, crossing their borders. (shrink)

The leader as shaman has three central roles: healer, connector, and sensemaker in the service of a better world. This paper argues that today’s leaders acting as shamans could become ‘shapeshifters,’ or more accurately ‘shape the shift,’ that is engage with organizational and systemic change needed to content with major problems like sustainability issues, climate change, and inequality, which business businesses are increasingly being asked to deal with as part of their societal roles. In the role of sensemaker, business leaders (...) can shape shifts towards great sustainability and responsibility by developing new memes that speak to others and resonate across different people and groups. Memes’ roles in change, as core cultural artifacts, on which values, business strategies, and belief systems are built, are generally overlooked but are an important element of shamanic leadership. Negri celebrates a conception of democracy in which the concrete powers of individual humans are not alienated away, but rather are added together: this is a democracy of the multitude. But how can the multitude act without alienating anyone’s power? To answer this difficulty, Negri explicitly appeals to Spinoza. Nonetheless, in this paper, I argue that Spinoza’s philosophy does not support Negri’s project. I argue that the Spinozist multitude avoids internal hierarchy through the mediation of political institutions and not in (...) spite of them; nor do these institutions merely emanate from the multitude as it is, but rather they structure, restrain and channel its passions. In particular, the required institutions are not those of a simple direct democracy. There may be other non-Spinozist arguments on which Negri can ground his theory, but he cannot legitimately defend his conception of the democratic multitude by appeal to Spinoza. (shrink)

Thomas Hobbes has been hailed as the philosopher of power par excellence; however, I demonstrate that Hobbes’s conceptualization of political power is not stable across his texts. Once the distinction is made between the authorized and the effective power of the sovereign, it is no longer sufficient simply to defend a doctrine of the authorized power of the sovereign; such (...) a doctrine must be robustly complemented by an account of how the effective power commensurate to this authority might be achieved. Nor is this straightforward: for effective political power can fluctuate, sometimes severely. In this light, the prevalent juridical reading of Hobbes’s political philosophy is inadequate. (shrink)

This study explores the pathways from the aspiration to make a difference in the world to vision and action of social entrepreneurs. Based on the qualitative analysis of interviews with 23 individuals who have pioneered institutions and initiatives around corporate responsibility, we find two predominant pathways to vision. The deliberate path starts with aspiration and moves through purpose toward a relatively intentional vision that ultimately leads to, and is subsequently informed by, action. The emergent path also begins with aspiration then (...) moves directly to action and only retrospectively to a sense of a vision behind the actions taken. The emergent path, in which action precedes vision, is contrary to the dominant assumption that vision leads to action in an entrepreneurial context and may be further characterized as either inadvertent or developmental. In advancing a conceptual model of the vision–action or action–vision trajectories of social entrepreneurs, this study highlights the iterative nature of vision. This study also demonstrates the importance of considering formative experiences that contribute to the aspiration to make some kind of a difference in the world, a sense of purpose or intentions, and core values and beliefs in examining the ethicality of social entrepreneurship. In the course of the last few decades, Bolzano has emerged as an important player in accounts of the history of philosophy. This should be no surprise. Few authors stand at a more central junction in the development of modern thought. Bolzano's contributions to logic and the theory of knowledge alone straddle three of the most important philosophical traditions of the 19th and 20th centuries: the Kantian school, the early phenomenological movement and what has come to be known as analytical (...) philosophy. This paper identifies three Bolzanian theoretical innovations that warrant his inclusion in the analytical tradition: the commitment to ‘logical realism’, the adoption of a substitutional procedure for the purpose of defining logical properties and a new theory of a priori cognition that presents itself as an alternative to Kant's. All three innovations concur to deliver what counts as the most important development of logic and its philosophy between Aristotle and Frege. In the final part of the paper, I defend Bolzano against a common objection and explain that these theoretical innovations are also supported by views on syntax, which though marginal are both workable and philosophically interesting. The frequency of the use of deception in American psychological research was studied by reviewing articles from journals in personality and social psychology from 1921 to 1994. Deception was used rarely during the developmental years of social psychology into the 1930s, then grew gradually and irregularly until the 1950s. Between the 1950s and 1970s the use of deception increased significantly. This increase is attributed to changes in experimental methods, the popularity of realistic impact experiments, and the influence of cognitive dissonance (...) theory. Since 1980 there appears to have been a decrease in the use of deception as compared to previous decades which is related to changes in theory, methods, ethical standards, and federal regulation of research. ABSTRACT In this article, we address the aporia(s) of the Olympic discourse produced by the troubled split between sport and politics. To start our argument, we will show that sporting governing bodies continuously insist that they are still on the other side of any kind of politics. Guided by Aristotle, who presented the reciprocity of ethics and politics, we will unveil the fallacy of this discourse. In a short genealogy of the relationship between sport, ethics, and politics, we will highlight (...) the Munich Olympics 1936 and Mexico Olympics 1968, where political engagement of sport was exposed clearly. At the same time, the supposed political neutrality of sport manifested an aristocratic preference for radical right regimes. After that, we will analyse the contemporary relation between sport, ethics, and politics in the light of recent developments, including sport’s ambiguous reaction on the Ukraine war. Further argument will be that sport’s in- and external politics, supported by sport ethics and the inherited mantra of the split between sport and politics, is more than just a hypocrisy. At the start, modern sport claims autonomy of governance to keep away from state domination, yet this very autonomy also freezes sport’s ethical core, forbidding athletes, coaches and others active in sport, to express any political engagement, other than passive acceptance of the regulation by governing sport bodies, as the only politics to be respected without deliberation. In the final part an alternative understanding of the dynamics between politics, the political and sport’s ethical core, will be presented to be included in the philosophy of sport and fully developed in following articles. Schopenhauer singles out Kant's theory of the sublime for high praise, calling it ‘by far the most excellent thing in the Critique of Aesthetic Judgement’, yet, in his main discussion of the sublime, he ridicules Kant's explanation as being in the grip of scholastic metaphysics. My first aim in this paper is to sort out Schopenhauer's apparently conflicted appraisal of Kant's theory of the sublime. Next, based on hisNachlaß,close readings of published texts and especially of his account of the experience (...) of tragic drama, I offer a reconstruction of Schopenhauer's theory of the sublime which understands it – against prevailing scholarly views – as atransformation ofrather than as a realdeparture fromthe Kantian explanation. Finally, I suggest that my interpretation of Schopenhauer's theory of the sublime has far-reaching consequences for a proper understanding of his views on freedom. (shrink)

The concept of organizational justice is important to understanding and predicting organizational behavior. A significant development in the research literature has been the separation of distributive and procedural justice. While much of the research has focused on negative outcomes, this research attempted to verify the presence of both forms of justice in the context of positive outcomes. Subjects completed an instrument designed to measure their perceptions of distributive and procedural justice. The subjects also reported their satisfaction and sense of fairness (...) with their salary increases, their belief that the procedures to award the increases had been followed, and their level of information and agreement regarding the salary program. These measures, along with size of salary increase and gender were examined to determine their impact on the subjects' perceived level of justice. The data support the existence of the two distinct forms of justice, but suggest that procedural justice may, in turn, branch out into two aspects. One category involves being informed, and a second appears to deal with acceptance of procedures. A series of relationships are then considered. Significant gender effects were non-existent. In attempting to improve ethical decision-making in business organizations, researchers have developed models of ethical decision-making processes. Most of these models do not include a role for law in ethical decision-making, or if law is mentioned, it is set as a boundary constraint, exogenous to the decision process. However, many decision models in business ethics are based on cognitive moral development theory, in which the law is thought to be the external referent of individuals at the level of cognitive development (...) that most people have achieved. Other theoretical bases of ethical decision models, social learning, and experientialism, also imply a role for law that is rarely made explicit. Law is a more important aspect of ethical decision-process models than it appears to be in the models. This paper will derive explicit roles for the law from the cognition, experientialism, and social learning theories that are used to build ethical decision-making models for business behavior. Digital communication now pervades all spheres of life, creating new possibilities for commodification: personal data and communication are the new resources of surplus value. This in turn brings about a totally new category of threats to privacy. With recourse to the culture industry critique of early critical theory, this article seeks to challenge basic theoretical assumptions held within a liberal account of privacy. It draws the attention to the entanglement of technical and socio-economic transformations and aims at elaborating an alternative (...) framing which takes into account that privacy is not in the first place a pre-political space for individual freedom but a constituted sphere in which social power relations are reproduced in a particularly deceitful way. With recourse to positions of critical theory, this article revisits the conceptual ambiguity of liberation and oppression and looks to draft prospects for a socio-theoretical justification and critique of privacy, updated for the digital age. Following the tradition of critical theory, the argument focuses on (new) forms of domination in and by privacy. It aims to prepare the ground for a critique of the social’s increasing commodification as well as an idea of privacy understood as reflexive participation in social practices. (shrink)

Law wrangles with setting and applying standards for the practice of medicine in many different arenas. One of the most prominent is medical malpractice litigation in which the trial process examines a physician's performance and measures it against the standard of care. The profession's prevailing custom, with some substantial tolerance for “respectable minority” views, has been the gold standard for scrutinizing physician practice and treatment decisions in the malpractice context. Using the profession's custom as the measure against which a physician's (...) performance is judged defers to the expertise of medicine. Deference to the medical profession is attractive as a tool for reining in law. Reliance on customary practice is criticized, however, for driving physicians to the relative safety of the middle of the herd. Creating such a strong incentive for compliance with customary practice can dampen medical innovation and the diffusion of new clinical knowledge. The safety of the herd can also deprive individual patients of the best care in their particular circumstances.Several current trends are strengthening claims that professional practice patterns are an inappropriate tool for distinguishing between high‐quality and substandard care. In particular, advocacy for evidence‐based medicine aggressively asserts that the traditional way of making medical treatment decisions is largely untethered from scientific method or data, rendering professional judgment, even in the aggregate, suspect.
